These general terms and conditions apply to all orders placed by private individuals and club members via the online shop

§ 2 Contract conclusion
§ 2.1 The presentation of the products in the online shop does not constitute a legally binding offer,
but an invitation to place an order. Errors excepted.
§ 2.2 By clicking the [Buy] button, you place a binding order for the goods listed on the
order page. The contract of sale comes into effect when we confirm your
order by sending an order confirmation by e-mail immediately after receipt of your order.
§ 2.3 Should our order confirmation contain typographical or printing errors or
should our price determination be based on technical errors in transmission, we are entitled to contest the order, whereby we must prove our error to you.
Any payments already made will be refunded to you without delay.
§ 3 Prices and deposits
§ 3.1 The prices stated on the product pages include the statutory value-added tax and other price components and do not include shipping costs.
§ 3.2 Deposits for replacement parts included in the price will be refunded by us immediately provided that the exchanged part is returned by you. The return shipping costs
of exchange parts shall be paid by the purchaser.
§ 4 Shipping costs
§ 4.1 For delivery within Germany we charge a flat rate of 9.00 Euro incl. 19% VAT per order.
§ 4.2 For delivery to other EU countries we charge a flat rate of 17.00 Euro incl. 19% VAT per order. For large-volume or heavy parts, depending on the destination, an additional surcharge may be added to cover the costs (after consultation with the buyer).
§ 4.3 For all customers, purchase from stock is possible. There are no Shipping costs. The goods will be made available for you to collect from the spare parts warehouse.
Customs clearance of the goods is the responsibility of the customer.
§ 4.4 If you choose "stock purchase" the shipping costs do not apply. The goods will be made available to you for collection from the spare parts warehouse.
§ 4.5 Orders with particularly bulky goods can only be picked up from the
spare parts warehouse. In this case the shipping costs will be waived. The affected products are marked in the online shop.
§ 5 Terms of delivery and reservation of self-delivery
§ 5.1 Delivery is made with Hermes Logistik Gruppe (HLG) or Deutsche Post World
Net (DHL) as a standard parcel or registered letter.
§ 5.2 The delivery time is, unless otherwise stated in the offer, approx. 6-8 days. For payment in advance, the delivery time begins with the receipt of the money on our account.
§ 5.3 f the delivery of the goods should fail despite three delivery attempts, we can cancel the contract.Any payments made will be refunded to you immediately.
§ 5.4 If the product ordered is not available because we have not been supplied with this product by our suppliers through no fault of our own, we will cancel the contract. In this case we will inform you immediately and, if necessary
offer you the delivery of a comparable product, if applicable. If no comparable
product is available or if you do not wish to receive a comparable product, we will reimburse you immediately for any consideration already paid.
§ 6 Terms of payment
§ 6.1 Payment can be made per order either in advance, by direct debit or by invoice.
§ 6.1.1 In the case of payment in advance, we will provide you with our bank details in the order confirmation.
The invoice amount is to be transferred to our bank account within 10 days after receipt of the order confirmation. The goods will be delivered after receipt of payment.
§ 6.1.2 The direct debit payment method is only available for club members.
The invoice amount will be debited from your account 14 days after the invoice date.
§ 6.1.3 The payment method invoice is only available for Club members.
If you choose the payment method invoice, you will receive our invoice together with the goods. The invoice amount is to be transferred to our account within 10 days.
§ 6.2 You only have the right to offset payments if your counterclaims are undisputed or have been recognised by us in writing or have been legally established by a court.
§ 6.3 You may only exercise a right of retention if the claims arise from the same contractual relationship.
§ 7 Cost sharing agreement
If you exercise your right of revocation, you must pay the regular costs of the return shipment.
§ 8 Reservation of ownership
The goods remain our property until full payment has been made. Prior to the transfer of ownership
pledging, assignment by way of security, processing or transformation
without our consent.
§ 9 Transport damage
If goods are delivered with obvious transport damage, please complain about such faults immediately to the delivery person and please contact us as soon as possible.
§ 10 Warranty
§ 10.1 The warranty is provided in accordance with the statutory regulations. For all goods delivered during the statutory warranty period of two years from the date of delivery, you have the legal right to
to subsequent fulfilment (at your choice: rectification of the defect or
or a new delivery) and - if the legal requirements are met - the legal rights to a reduction in price or cancellation of the contract and, in addition, to compensation for damages.
§ 10.2 We do not accept any liability for damage or defects that are the result of
improper use, operation and storage, negligent or faulty care and maintenance, through overloading or improper repair by an unauthorised service partner.
§ 10.3 If you wish to have a defective product repaired or replaced,
please return the product free of charge.
§ 11 Complaint procedure
Alternative Dispute Resolution pursuant to Art. 14 (1) ODR Regulation and Art. 36 VSBG: The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at http://ec.europa.eu/consumers/odr/. We are not obliged to participate in a dispute resolution procedure at a consumer arbitration board and
we are not obliged and, in principle, not prepared to participate.
§ 12 Final clauses
Should any provision of these General Terms and Conditions be invalid, the contract shall remain in force. Instead of the invalid provision, the relevant statutory provisions shall apply.
